Important: These Terms contain provisions affecting your legal rights, including limitation of liability, binding individual arbitration, and a class-action waiver. Please read these Terms carefully before purchasing tickets, merchandise, or attending a Big Dill event.
Welcome
These Terms of Service ("Terms") govern your use of bigdill.com and any purchases you make from us, including event tickets to The Big Dill World's Largest Pickle Party® and merchandise. The site is operated by Viral Festivals, LLC.
By visiting our site, creating an account, purchasing anything from us, checking an acknowledgment box at checkout, or attending a Big Dill event with a ticket purchased by you or for you, you agree to these Terms.
We've written these in plain English where possible, because a legal document shouldn't be the thing standing between you and a great festival day. The sections most relevant to you depend on what you're doing:
- Buying event tickets? Section 4 covers everything specific to ticket purchases.
- Buying merchandise? Section 5 covers merchandise and custom print-on-demand products.
- Just browsing the site? Sections 1 through 3 and 6 through 18 cover general site use, privacy, communications, liability, dispute resolution, and legal terms.
If any specific terms presented on an event page, product page, cart acknowledgment, checkout page, ticket confirmation, or official event communication conflict with these Terms, the more specific terms control for that purchase, except where prohibited by law.
Section 1: Site Use and General Conditions
By using bigdill.com, you agree to use the site only for lawful purposes and in accordance with these Terms. You may not:
- Use the site for any illegal or unauthorized purpose
- Transmit worms, viruses, malware, or any code of a destructive nature
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the site without our written permission
- Use the site to harass, abuse, harm, threaten, or discriminate against others
- Submit false, inaccurate, misleading, or fraudulent information
- Interfere with or circumvent security features
- Collect, scrape, or track the personal information of others
- Spam, phish, scrape, crawl, pretext, or otherwise misuse the site
- Use bots, scripts, automated purchasing tools, or similar technology to purchase tickets or merchandise unless expressly authorized by Big Dill in writing
- Attempt to interfere with the fair operation of ticket sales, promotions, contests, giveaways, voting, or event-related programs
We reserve the right to refuse service to anyone at any time to the fullest extent permitted by law. A breach of these Terms may result in immediate termination of your access to the site, cancellation of orders, refusal of admission, removal from an event, or other action permitted by law.
Section 2: Accuracy of Information
We make reasonable efforts to keep information on the site accurate and current, including product descriptions, event details, pricing, availability, age requirements, accessibility information, shipping information, and ticket details.
Occasionally, information may contain typographical errors, inaccuracies, omissions, outdated details, or availability changes. We reserve the right to correct errors, update information, or cancel orders affected by inaccurate information where permitted by law, including after an order has been submitted.
Nothing in this section limits any remedy required by applicable law for canceled events, counterfeit tickets, tickets that fail to conform to the description advertised or represented to the purchaser, products that do not match the order, or any other right that cannot legally be waived.
We have made reasonable efforts to display product and event images accurately, but we cannot guarantee that your screen will display colors, details, scale, or appearance exactly.
Section 3: Account, Billing, and Communications
Account Information
You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account information, including email address, phone number, billing information, and payment method, so we can process your transactions, deliver tickets, ship merchandise, and contact you when needed.
Order Acceptance
We reserve the right to refuse, limit, or cancel any order at our discretion, including orders that appear to be fraudulent, abusive, mistaken, unauthorized, placed by dealers, resellers, brokers, or distributors, or orders that violate these Terms. We may, in our discretion, limit quantities purchased per person, household, billing address, email address, payment method, or order.
If we cancel an order after payment has been collected, we will provide any refund required by law.
Buyer Age and Authority
You must be at least 18 years old, or the age of majority in your state, to purchase tickets or merchandise through bigdill.com.
If you purchase tickets for other people, you are responsible for making sure those people understand and follow these Terms, including ticket type, event date, event city, age restrictions, venue rules, refund policy, and transfer rules, to the fullest extent permitted by law.
Payment Processors and Express Checkout
We may accept payment through Shopify Payments, Shop Pay, Shop Pay Installments, Apple Pay, Google Pay, Amazon Pay, credit card networks, debit card networks, installment providers, or other payment processors. Your use of a payment method may also be governed by the terms, privacy policy, and dispute rules of that payment provider.
Using an express checkout method does not change the ticket terms, age restrictions, refund policy, event rules, merchandise policy, or any other terms applicable to your purchase.
Communications
We may send transactional emails or texts about your order, ticket delivery, event updates, safety notices, accessibility updates, venue rules, age restrictions, postponements, cancellations, refunds, transfers, or shipping information. These messages are part of your purchase and may continue even if you opt out of marketing communications.
Marketing emails and texts are governed by the consent language presented when you sign up or purchase, our Privacy Policy, and applicable law. Marketing SMS consent is not required to purchase from us. You may opt out of marketing messages at any time, but we may still send transactional messages related to your purchase.
Transactional messages should be used for transaction-related purposes. Promotional offers, upgrades, merchandise, future event announcements, or other marketing content may be sent only where permitted by law and applicable consent.
Children's Privacy
Purchases must be made by adults. We do not knowingly collect personal information directly from children under 13 through our site. If we learn that we collected personal information directly from a child under 13 without legally required parental consent, we will take appropriate steps to delete it or obtain required consent.
Certain event features, contests, giveaways, voting, scavenger hunts, photo challenges, app features, or promotions may have separate rules, age requirements, parental consent requirements, or privacy terms.
State-Specific Rights
Some states provide specific rights for purchasers, including rights related to canceled events, counterfeit tickets, misdescribed tickets, pricing disclosures, accessibility, public accommodations, alcohol laws, minors on licensed premises, merchandise, shipping, privacy, or consumer protection. Nothing in these Terms limits rights that cannot legally be waived. If these Terms conflict with a non-waivable law, that law controls.
Section 4: Ticket Purchase Terms
This section applies specifically to your purchase of tickets to Big Dill events. If you're buying tickets, please read this section carefully.
4.1 Welcome to The Big Dill
When you buy a ticket through bigdill.com, check the acknowledgment box at checkout, or attend a Big Dill event with a ticket purchased by you or for you, you're agreeing to these Terms.
The Big Dill is a live event. Because Big Dill commits to venues, vendors, entertainers, staffing, production, security, marketing, insurance, supplies, and infrastructure in advance, ticket purchases are final except as expressly stated in these Terms or required by applicable law.
We try to be reasonable when we can. If life happens and you need to reach out, please do. Big Dill may make case-by-case courtesy accommodations based on availability, timing, and circumstances. These accommodations are at our sole discretion, are not a right, and do not change the all-sales-final policy.
4.2 Who Can Attend
Big Dill is a family-friendly festival, and most of our tickets reflect that. Standard, Premium, Early Entry, and Late Brine tier tickets are generally open to all ages unless a specific event page states otherwise. Kids ticket holders can be ages 2 through 13. Children under 2 attend free with a paying adult unless otherwise stated for a specific event, venue, or ticket tier.
VIP tickets are 21 and older only. This applies to all VIP tickets across every Big Dill tour stop, including the Snooki VIP Experience at our Arlington, Texas event.
The reason VIP is age-restricted: VIP packages include venue-provided food and beverage, and the venue serves those items under its own liquor license. Because alcohol is part of the VIP experience, the venue requires all VIP attendees to be 21 or older. Valid government-issued ID will be checked at entry.
No person under 21 may enter any VIP area or use any VIP ticket, including infants and children under 2. Purchasing tickets in separate orders does not bypass this rule. The "children under 2 attend free" policy applies only to family-friendly ticket tiers, not VIP.
VIP tickets cannot be combined with Kids tickets in the same order. Our cart system is designed to prevent this combination. If your group includes children, please purchase appropriate family-friendly tickets, such as Standard, Premium, or Early Entry, for the adults attending with them.
Pennsylvania Events: Special Rules for Minors
Pennsylvania alcohol law and venue rules may require that minors at venues licensed to serve alcohol be accompanied by a parent, legal guardian, or "proper supervisor." For Pennsylvania alcohol-law purposes, "minor" means anyone under 21, including attendees ages 18, 19, and 20.
A proper supervisor generally means an adult 25 years of age or older who is directly responsible for the minor's care and who keeps the minor within the supervisor's sight or hearing. In Philadelphia specifically, one proper supervisor may supervise no more than five minors at one time.
This applies to our Philadelphia event regardless of which ticket tier you purchase. If you're bringing a minor, meaning anyone under 21, to our Philadelphia event, please plan accordingly. Venue staff may verify parent, guardian, or proper supervisor status at entry.
If you arrive with a minor and cannot meet these requirements, the venue may refuse entry, and Big Dill cannot offer a refund except where required by applicable law.
We highlight the Philadelphia under-21 supervision rules on the event page, product page, cart acknowledgment, confirmation email, and pre-event reminders, not just in these Terms, because 18-, 19-, and 20-year-olds may not realize "minor" applies to them under Pennsylvania alcohol law.
Additional Age Restrictions
Some events may have additional age restrictions due to local law, venue licensing, venue policy, city requirements, or event-specific programming. Always confirm the age requirements for your specific event before purchasing.
Note on Attendee Age Verification
When you check the acknowledgment box at checkout, you're confirming the age requirements for your specific ticket type. If we discover at the gate that someone using a VIP ticket is under 21, that ticket will not be honored, and the ticket holder will not receive a refund except where required by applicable law.
4.3 How Tickets Work
Big Dill tickets are digital. You'll receive them at the email address you provided at purchase, with a unique QR code for each ticket.
Important: Confirm Your Tickets Arrived
Right after purchase, check your inbox and your spam folder for an email from Big Dill with your tickets attached or linked. We may also send a follow-up text to the phone number you provided so you can verify your tickets are secured. Always make sure you have your tickets in hand before festival day.
Adding Tickets to Your Phone Wallet
We strongly recommend adding your tickets to Apple Wallet or Google Wallet right after you receive them. Wallet-stored tickets are harder to lose, may work without internet at the gate, and may show up automatically when you arrive at the venue.
One Ticket, One Entry
Each QR code scans once at the gate. Once a QR code is scanned, that ticket is used.
Can't Find Your Tickets?
Email us at info@bigdill.com or reply to any text we send you. We'll verify your purchase and resend the tickets to the email address associated with the order or another verified email address where appropriate.
Tickets Are Transferable
If you can't make it but a friend can, you may send them your ticket. We do not generally scan IDs against tickets at the gate. As long as the person at entry has a legitimate, scannable QR code from a Big Dill order, the name on the ticket does not need to match the person using it.
VIP tickets transferred to anyone under 21 will not be honored at the gate, and no refund will be issued except where required by applicable law.
Be Smart About Who You Forward Your Tickets To
Once a QR code is scanned at the gate, that ticket is used. Big Dill is not responsible for tickets that are sold, shared, forwarded, posted, copied, stolen, duplicated, transferred without your authorization, or scanned in by the wrong person.
If you purchase tickets from an unauthorized third party, Big Dill cannot guarantee that the ticket is valid, transferable, authentic, unused, or refundable.
Re-Entry Policy
Re-entry is determined by the venue, not by Big Dill. Most venues do not allow re-entry once you scan in, primarily for liability and security reasons. Exceptions may be made at the venue's discretion for medical emergencies or other situations cleared directly with venue security.
Ticket Validity
Your ticket is valid only for the specific event, date, city, and tier you purchased.
4.4 Refunds, Transfers, Pricing, and Cancellations
All Sales Final
Except as expressly stated in these Terms or required by applicable law, all ticket sales are final and non-refundable. We do not issue refunds for change of plans, scheduling conflicts, failure to attend, weather concerns where the event still occurs, lineup changes, vendor changes, sponsor changes, activity changes, schedule changes, menu changes, buyer's remorse, or tickets purchased for the wrong city, date, tier, quantity, or age group after checkout confirmation.
Because Big Dill commits to venues, vendors, performers, staffing, production, and infrastructure months in advance, the all-sales-final policy is an important part of how the event is built and operated.
No Ticketing Fees
Big Dill does not add ticketing fees, service fees, convenience fees, processing fees, platform fees, or hidden mandatory fees to our ticket prices. The ticket price shown is the ticket price charged by Big Dill. Any applicable taxes, shipping charges, optional add-ons, or legally required charges, if collected, will be shown before payment.
Maryland Ticket Pricing and Refund Rights
For Maryland events, Big Dill will provide any ticket pricing disclosures, itemization, and refund rights required by Maryland law. This may include displaying the total ticket price and an itemized listing of charges during the purchase process, and providing refunds required by law for canceled events, counterfeit tickets, or tickets that fail to conform to the description advertised or represented to the purchaser.
Nothing in these Terms limits any Maryland ticket purchaser right that cannot legally be waived.
Transfers to Another Big Dill Event
Before the event date, you may request a one-time transfer to another Big Dill event or future date. Transfers are not guaranteed and depend on availability, timing, inventory, venue requirements, ticket type, price differences, and operational feasibility.
If the destination ticket costs more than what you originally paid, the difference is your responsibility. Big Dill does not refund the price difference if your transfer is to a less expensive ticket.

Postponement or Rescheduling
If an event is postponed or rescheduled, your ticket will automatically be valid for the new date. A postponement is not a cancellation and is not, by itself, a basis for refund unless required by applicable law.
We will make reasonable efforts to reschedule the event in the same market and within a commercially reasonable time. If Big Dill determines that the event cannot reasonably be rescheduled, or if the replacement event is not substantially similar, we will treat it as a cancellation.
We will communicate the new date by email, SMS where available, and/or other reasonable customer communication methods.
Cancellation
If Big Dill cancels an event and does not reschedule a substantially similar event in the same market within a commercially reasonable time, we will issue a refund for the amount paid to Big Dill for the affected ticket, including any taxes we collected, unless a different remedy is required or permitted by applicable law.
Refunds will be made to the original payment method unless another method is required or reasonably necessary. Nothing in these Terms limits any refund rights that cannot be waived under applicable law.
Event Changes
Event times, layouts, vendors, sponsors, activities, performers, menus, activations, indoor/outdoor allocation, entrances, stages, schedules, and operational details may change with or without prior notice where operationally necessary. We will communicate material changes when practical.
Tickets are sold for admission to the Big Dill experience as a whole, except where a ticket package expressly includes a named premium component.
Operational Changes, Delayed Entry, or Partial Closures
Minor delays, layout changes, capacity controls, temporary area closures, schedule changes, entrance changes, weather-related adjustments, crowd-flow changes, or operational adjustments are not a basis for refund unless required by applicable law.
If a material portion of the event is canceled, unavailable, or materially different from what was advertised, Big Dill will provide any remedy required by applicable law.
Rain, Weather, and Indoor/Outdoor Operations
Big Dill events may include indoor and outdoor areas depending on the city and venue. Events generally operate rain or shine unless conditions make the venue unsafe, inaccessible, or legally unavailable. Big Dill and the venue may adjust layouts, entrances, schedules, activities, or indoor/outdoor allocation due to weather, safety, crowd flow, or operational needs.
Weather concerns are not a basis for refund if the event occurs, except where required by applicable law.
Sampling, Food, and Activations
Sampling, food, beverage, giveaways, activations, brand experiences, contests, games, and vendor offerings are subject to availability, venue operations, crowd flow, safety, vendor participation, sponsor participation, and supply.
"Unlimited sampling," where advertised, means that participating sampling opportunities do not require a separate per-sample purchase while supplies and event operations allow. It does not guarantee that every attendee will receive every item from every vendor, sponsor, or sampling station.
Named Celebrity or Premium Component Packages
Some packages, including the Snooki VIP Experience, may be sold as including a named celebrity, meet-and-greet, photo opportunity, hosted moment, or similar premium component.
Celebrity appearances and premium components are subject to schedule, travel, illness, security, venue operations, production needs, safety, force majeure, and other circumstances beyond Big Dill's reasonable control. Big Dill may modify the schedule, timing, format, location, order, duration, or operational details of that component.
If the named premium component is canceled entirely and is not replaced with a reasonably comparable benefit, Big Dill will provide a remedy for the incremental premium value of that component, which may include a credit, transfer, partial refund, or other remedy required by applicable law.
Unless required by law, cancellation, modification, delay, rescheduling, or format change of a named premium component does not automatically entitle the purchaser to a full refund of the entire event ticket if the event itself occurs.
Unless otherwise stated on the event page, the incremental premium value means the difference between the price paid for the named premium package and the closest comparable non-named VIP ticket available for that event at the time of purchase.
Discretionary Accommodations
Big Dill may make case-by-case courtesy accommodations based on availability, timing, and circumstances. These accommodations are at our sole discretion, are not a right, and do not establish precedent.
Questions, Concerns, and Chargebacks
If you have a concern about your purchase, please contact us at info@bigdill.com first so we can try to help.
If we believe a payment dispute is inaccurate, including where a ticket was delivered, accepted, transferred, used, or scanned at the festival, Big Dill may respond to the payment provider with relevant records. These records may include order details, cart contents, ticket delivery logs, ticket resend logs, scan data, event attendance data, customer service communications, checkout acknowledgment, IP address, timestamp, user agent, the Terms version accepted at purchase, event-page disclosures, product-page disclosures, and other records related to the transaction.
Nothing in this section limits any non-waivable rights you may have under applicable law or card-network rules.
4.5 When Things Don't Go As Planned
Big Dill is built differently than most festivals. We partner with major entertainment complexes that offer significant indoor and outdoor space, so our experience is designed to hold up across a wide range of conditions.
Sometimes circumstances beyond our control affect an event. Causes may include, but are not limited to:
- Government orders or public health emergencies
- Acts of terrorism, war, or civil unrest
- Venue inaccessibility, fire, utility failure, or infrastructure failure
- Strikes, labor disputes, vendor failures, shipping delays, or supply chain failures
- Severe weather, natural disasters, or other natural events that compromise venue safety
- Security threats, emergency conditions, or law enforcement instructions
- Cyber events, technology outages, or ticketing-system disruptions beyond our reasonable control
- Acts of God or any other circumstances beyond our reasonable control
When these occur, we'll handle them based on the rescheduling, cancellation, event changes, and refund provisions above.
Force Majeure
Big Dill, Viral Festivals, LLC, and our affiliated entities are not liable for failure to perform our obligations under these Terms when failure is caused by circumstances beyond our reasonable control, except where applicable law requires a refund, credit, or other remedy.
4.6 VIP Package and Venue Food/Beverage
VIP tickets include venue-provided food and beverage. Alcohol, where available, is served by the licensed venue operator or its authorized designee in accordance with applicable law, venue policy, and the venue's liquor license. Big Dill does not sell alcohol, serve alcohol, control alcohol service decisions at the point of service, or determine whether a particular attendee will be served alcohol.
Venue staff may refuse alcohol service for intoxication, invalid ID, suspected fake ID, safety concerns, legal restrictions, capacity issues, or venue policy. Refusal of alcohol service is not a basis for refund.
Specific food and beverage items are subject to availability. VIP food and beverage offerings vary by event, venue, and operational conditions. Specific menu items are not guaranteed unless expressly stated as guaranteed on the applicable event page or ticket product page.
You are solely responsible for your own consumption of alcohol or any other substances at the festival. You are responsible for arranging safe transportation to and from the festival.
4.7 At the Festival: Conduct, Safety, Venue Rules, and Right to Refuse
Your ticket is a revocable license to attend the festival. Big Dill, the venue, security, or law enforcement may refuse admission or remove any attendee, without refund except where required by law, for violating these Terms, venue rules, posted policies, law, safety instructions, or staff instructions, or for conduct that is disruptive, unsafe, threatening, intoxicated, unlawful, or harmful to the event experience.
All attendees must follow the rules, policies, instructions, bag policies, security policies, age policies, accessibility procedures, alcohol policies, and posted instructions of the applicable venue. Venue rules are incorporated into these Terms by reference to the extent they apply to your attendance.
Specifically, Big Dill and the venue may refuse entry or remove attendees for:
- Disorderly conduct, fighting, harassment, or threatening behavior
- Visible intoxication or impairment
- Possession of weapons, drones, illegal substances, or prohibited items
- Use of fake, altered, borrowed, expired, or invalid ID
- Bringing outside food or alcoholic beverages where prohibited
- Unauthorized vending, sampling, brand activation, solicitation, distribution, filming, or commercial activity
- Refusing bag check, security screening, ID check, or wristband procedures
- Refusing to comply with venue staff, Big Dill staff, security, law enforcement, or posted rules
- Entering restricted areas or attempting to bypass ticketing, wristband, age, or security controls
- Any conduct that endangers other attendees, staff, vendors, performers, sponsors, venue personnel, or the event
Bag checks and security screening may be required at all venues. Big Dill is not responsible for items confiscated by venue security or law enforcement.
Removal from the festival results in no refund except where required by applicable law.
4.8 Photos, Video, and Media Release
By entering a Big Dill event, you understand that you may be photographed, filmed, livestreamed, recorded, or otherwise captured in event media.
You grant Big Dill, Viral Festivals, LLC, our affiliates, sponsors, media partners, contractors, licensees, and designees the right to use your image, likeness, voice, appearance, and statements captured at or in connection with the event in event-related, promotional, advertising, social media, archival, editorial, press, recap, and commercial materials, without additional notice or compensation, to the fullest extent permitted by law.
This release is intended to cover ordinary event photography, videography, crowd footage, recap content, promotional content, social media content, press content, sponsor recap content, and other uses related to Big Dill events and the Big Dill brand. It does not waive rights that cannot legally be waived.
Minors
General crowd and event photography may include minors attending the event. If you attend with a minor, you represent that you are the parent or legal guardian, or that you have authority to accompany the minor at the event.
For close-up, posed, interview, testimonial, endorsement-style, sponsor-specific commercial use, or other targeted use of a minor's image, likeness, voice, appearance, or statements, Big Dill may require separate written permission from the minor's parent or legal guardian where required or appropriate.
Attendee-Shared Content
If you tag Big Dill, use an official Big Dill event hashtag, send content to Big Dill, upload content to a Big Dill platform, participate in a Big Dill photo challenge, or otherwise submit event-related photos, videos, captions, comments, or posts to us, you grant Big Dill a non-exclusive, worldwide, royalty-free license to repost, share, edit for format, display, distribute, and use that content in Big Dill social media, marketing, advertising, archival, recap, and promotional materials, subject to applicable law.
You represent that you own or have the right to share the content and that our use will not violate another person's rights, including copyright, trademark, privacy, publicity, or other rights.
4.9 Allergies, Health, and Personal Responsibility
Assumption of Risk
You understand that attending a live festival involves inherent risks, including crowds, weather, loud music, flashing lights, uneven surfaces, stairs, curbs, slips, falls, food or beverage reactions, allergen exposure, alcohol-related conduct by others, physical activities, games, contests, vendor interactions, and contact with other attendees. You voluntarily assume those risks to the fullest extent permitted by law.
Food, Allergens, and Independent Vendors
Food and beverage items at our festivals are provided by independent vendors, sponsors, venues, or third parties. Big Dill does not control every ingredient, preparation method, cross-contact risk, or food-handling practice. If you have allergies, dietary restrictions, or medical conditions, ask the vendor directly before consuming any item. No event area should be considered allergen-free.
We offer non-pickle food options at all events for attendees with dietary preferences or restrictions, but we cannot guarantee allergen-free preparation.
Medical Conditions and Sensory Considerations
Big Dill events may include loud music, amplified sound, stage lighting, crowds, costumes, mascot appearances, games, contests, food sampling, alcohol service by venues, and other sensory elements. Attendees are responsible for making personal decisions about whether the event environment is appropriate for their own health, medical, dietary, mobility, sensory, or personal circumstances.
4.10 Accessibility and Service Animals
Big Dill is committed to providing an accessible event experience. Accessibility features vary by venue, city, layout, and event design. Guests who need accessibility information or reasonable accommodations should contact us at info@bigdill.com before the event so we can coordinate with the venue.
Advance notice helps us prepare and coordinate, but it is not required to receive accommodations required by law.
Big Dill may also provide event-specific accessibility information on event pages, FAQs, pre-event emails, venue maps, or a dedicated accessibility page. Where applicable, accessible ticketing, entry, routes, restrooms, viewing areas, service-animal policies, and accommodation procedures will be handled in coordination with the venue.
Service animals, and miniature horses where required by law, are permitted as required by applicable law. Pets, emotional support animals, therapy animals, and comfort animals are not permitted unless required by applicable law.
Section 5: Merchandise and Custom Print-on-Demand Products
This section applies to your purchase of merchandise from bigdill.com.
Custom Print-on-Demand Products
Most Big Dill merchandise is custom printed to order. Once you place an order, the item is produced specifically for you and generally cannot be restocked or resold.
Refund and Replacement Policy
We will replace or refund merchandise for:
- Misprinted items, including printing errors
- Torn, damaged, or defective items caused by manufacturing or fulfillment issues
- Items that do not match the order, such as wrong size shipped versus ordered, wrong color, wrong product, or wrong design
- Items materially different from the product purchased, except for ordinary differences in color, placement, scale, texture, or appearance caused by screen display, product variation, print process, or manufacturing tolerances
We will not replace or refund merchandise for:
- Customer ordered the wrong size
- Customer ordered the wrong item or color
- Customer entered the wrong shipping address
- Customer changed their mind
- Customer does not like the fit, fabric, color, feel, or appearance after receiving the item, where the item matches the order and product description
- Any case where the order matched what was produced and shipped, except where applicable law requires otherwise
To request a refund or replacement, email info@bigdill.com within 30 days of delivery with a photograph and a brief explanation of the issue. We may request additional information to evaluate the issue.
If your request is approved, Big Dill may provide a replacement, refund, store credit, or other remedy permitted by law. Refunds will generally be processed to the original payment method. Processing times vary by payment provider.
Shipping, Delivery, and Address Issues
You are responsible for providing a complete and accurate shipping address at checkout. Big Dill is not responsible for orders delayed, returned, misdelivered, or lost because the customer provided an incorrect or incomplete shipping address.
Carrier delays, tracking delays, weather delays, holiday delays, and other shipping disruptions may occur and are not always within Big Dill's control.
If tracking shows that an item was delivered but you did not receive it, please contact us and the carrier promptly. Big Dill may, in its discretion, assist with carrier claims or courtesy accommodations, but we are not responsible for theft, loss, or damage after confirmed delivery except where required by law.
Returns
Because most merchandise is custom printed and not restockable, you generally do not need to ship items back when a refund or replacement is approved. The original item is yours to keep or give away unless we specifically request its return.
Discretionary Accommodations
Big Dill may make case-by-case courtesy accommodations based on availability, timing, and circumstances. These accommodations are at our sole discretion, are not a right, and do not establish precedent.
Section 6: Optional Tools and Third-Party Services
We may provide access to third-party tools, services, payment methods, ticketing services, maps, forms, links, event platforms, app features, or other services through bigdill.com over which we have no control.
We provide access to such tools "as is" and "as available" without warranties or representations, except where required by law. We have no liability arising from your use of optional third-party tools or services to the fullest extent permitted by law. Your use is at your own risk and may be subject to the third party's own terms and privacy policy.
Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating third-party content and have no responsibility for third-party materials, products, or services. Complaints or questions about third-party products should be directed to the third party.
Section 7: User Comments, Feedback, and Submissions
If you send us comments, suggestions, ideas, photos, videos, captions, reviews, testimonials, or other submissions, whether requested or unrequested, you agree that we may edit, copy, publish, distribute, translate, display, and use them in any medium without restriction, compensation, or obligation to maintain confidentiality, subject to applicable law.
You agree that your submissions will not violate any third-party rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights. You will not submit anything libelous, obscene, abusive, threatening, misleading, infringing, or unlawful. You will not use a false identity or impersonate another person.
You are solely responsible for your submissions.
We may, but are not obligated to, monitor, edit, or remove content we determine is unlawful, offensive, threatening, defamatory, obscene, infringing, misleading, or otherwise objectionable.
Section 8: Big Dill's Brand and Content
The Big Dill, World's Largest Pickle Party, and related names, logos, taglines, designs, characters, event names, activations, content, and marks are trademarks, service marks, copyrights, trade dress, or other intellectual property owned by or licensed to Viral Festivals, LLC.
Unauthorized commercial use of Big Dill trademarks, logos, branding, event names, characters, designs, or event content is prohibited.
Attendee content is governed by Section 4.8 and Section 7.
Nothing in these Terms grants you any ownership or license to use Big Dill intellectual property for commercial purposes without our prior written permission.
Section 9: Privacy
Your submission of personal information through bigdill.com is governed by our Privacy Policy. Please review it for details on how we collect, use, disclose, retain, and protect your information, and how you may exercise rights available under applicable privacy laws.
Section 10: Errors, Inaccuracies, and Omissions
Occasionally the site, event pages, product pages, emails, texts, ads, social posts, confirmations, or other communications may contain typographical errors, inaccuracies, or omissions related to product descriptions, ticket descriptions, pricing, promotions, offers, shipping charges, transit times, event times, event features, availability, age restrictions, or accessibility details.
We reserve the right to correct errors, update information, or cancel orders if information is inaccurate, where permitted by law, including after an order has been submitted.
Nothing in this section limits any remedy required by applicable law for canceled events, counterfeit tickets, tickets that fail to conform to the description advertised or represented to the purchaser, products that do not match the order, or other legally protected claims.
We have no obligation to update information except as required by law.
Section 11: Modifications to Services, Events, and Prices
Prices and availability may change before purchase without notice.
For tickets already purchased, event changes, postponements, rescheduling, cancellations, premium component changes, and remedies are governed by Section 4.
For merchandise already purchased, merchandise fulfillment, refund, replacement, shipping, and remedy terms are governed by Section 5.
We may modify or discontinue site features, optional tools, promotions, products not yet purchased, merchandise designs not yet purchased, or services not yet purchased at any time, subject to applicable law.
Section 12: Disclaimer of Warranties
We do not guarantee that your use of bigdill.com will be uninterrupted, timely, secure, error-free, or free from technology issues.
We do not warrant that the results from use of the site will be accurate or reliable, except where required by law.
Your use of the site and any products or services obtained through it is at your sole risk to the fullest extent permitted by law. Products and services are provided "as is" and "as available," without warranties or conditions of any kind, except as expressly stated by us or required by law, including all implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Nothing in this section limits any warranty, remedy, or right that cannot legally be waived.
Section 13: Dispute Resolution, Arbitration, and Class Waiver
Please read this section carefully. It affects your legal rights. It requires most disputes to be resolved through individual arbitration instead of in court, and it limits class actions, class arbitrations, and representative actions, except where prohibited by law.
13.1 Informal Resolution First
Before either you or Viral Festivals, LLC begins arbitration or a lawsuit, the party raising the dispute must first send a written notice of dispute.

Notices from Big Dill will be sent to the email address associated with your order or account.
The notice must include the sender's name, contact information, order number if applicable, a description of the dispute, and the specific relief requested. The parties will make a good-faith effort to resolve the dispute informally for 30 days after the notice is received.
13.2 Agreement to Arbitrate
Except for disputes that qualify for small claims court, disputes involving intellectual property misuse, or claims that cannot be required to be arbitrated under applicable law, you and Viral Festivals, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, bigdill.com, any purchase, any ticket, any merchandise order, any event, any communication from us, or your attendance at a Big Dill event will be resolved by binding individual arbitration.
This agreement to arbitrate is governed by the Federal Arbitration Act.
13.3 Small Claims Court
Either party may bring an individual claim in small claims court if the claim qualifies. Small claims may be filed in the county where you reside, the county where the event occurred, New Castle County, Delaware, or another court permitted by applicable law.
13.4 Arbitration Provider and Rules
Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, except as modified by these Terms.
If the American Arbitration Association is unavailable or unwilling to administer the arbitration, the parties will agree on another reputable arbitration provider. If the parties cannot agree, a court of competent jurisdiction may appoint an arbitration provider.
13.5 Arbitration Location and Format
For claims of $10,000 or less, arbitration will be conducted by documents only, by telephone, or by videoconference, unless the arbitrator determines that an in-person hearing is necessary.
For larger claims, the arbitrator will determine the hearing format. Any in-person hearing will take place in the county where you reside, the county where the event occurred, New Castle County, Delaware, or another location agreed by the parties.
13.6 Fees
Your responsibility for arbitration fees will be limited to the amount you would pay to file a case in small claims court or the consumer filing fee required by the arbitration provider, whichever is lower, unless the arbitrator determines that your claim is frivolous or was filed for an improper purpose.
Big Dill will pay any additional arbitration fees required by the arbitration provider's consumer rules, unless applicable law allows otherwise.
13.7 Individual Relief Only
The arbitrator may award the same individual relief that a court could award, including individual damages, statutory damages, attorneys' fees where authorized by law, and individual injunctive relief where permitted.
The arbitrator may not award relief for or against anyone who is not a party to the arbitration.
13.8 Class-Action and Representative-Action Waiver
You and Viral Festivals, LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, class member, private attorney general, or representative in any class action, class arbitration, collective action, consolidated action, or representative proceeding.
The arbitrator may not consolidate more than one person's claims and may not preside over any class, collective, consolidated, private attorney general, or representative proceeding, except where this waiver is prohibited by law.
13.9 Mass Arbitration Procedures
If 25 or more similar arbitration demands are filed against Viral Festivals, LLC by or with the assistance of the same law firm, group of law firms, organization, or coordinated claimants, the demands will be treated as a mass arbitration.
The arbitration provider's mass arbitration rules and fee schedule will apply if available. If the provider does not have mass arbitration rules, the parties agree that a process arbitrator may be appointed to resolve administrative issues, including whether pre-arbitration requirements were satisfied, how cases should be staged, and how to promote fair and efficient resolution.
Nothing in this section permits class arbitration or representative arbitration.
13.10 Opt-Out Right
You may opt out of this arbitration agreement and class-action waiver within 30 days after your purchase by emailing info@bigdill.com with the subject line Arbitration Opt-Out.
Your opt-out notice must include your name, order number, email address used for purchase, and a clear statement that you opt out of Section 13. Opting out will not affect your purchase, ticket, account, or ability to attend the event.
13.11 Exceptions
Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, account security, event safety, or unauthorized commercial use of tickets, trademarks, or content.
13.12 Severability
If any part of this Section 13 is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable as to a claim, that claim must proceed in court and not in arbitration.
13.13 Governing Law and Court Venue Fallback
These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs this Section 13 and any non-waivable consumer protection, ticketing, accessibility, alcohol, privacy, public-accommodation, or other law will apply where required.
If a dispute proceeds in court rather than arbitration, it must be brought in a court of competent jurisdiction in Delaware, the state where the event occurred, or another venue required by applicable law.
Section 14: Limitation of Liability
To the fullest extent permitted by law, Big Dill, Viral Festivals, LLC, our affiliates, owners, officers, directors, employees, contractors, sponsors, vendors, venues, event partners, licensors, suppliers, and service providers will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising from your use of the site, your purchase, your ticket, your merchandise order, your attendance at any event, or your inability to attend any event.
To the fullest extent permitted by law, our maximum liability for claims relating to a purchase, ticket, merchandise item, or event attendance is limited to the amount you paid Big Dill for the item or ticket giving rise to the claim.
Sponsors, vendors, venues, event partners, licensors, suppliers, and service providers are intended third-party beneficiaries of this limitation of liability to the extent a claim relates to their role in the event, site, product, or service.
Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, personal injury, or any other liability where such limitation is not permitted by law. Nothing in these Terms limits rights that cannot legally be limited.
Section 15: Indemnification
You agree to indemnify, defend, and hold harmless Big Dill, Viral Festivals, LLC, and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, employees, sponsors, vendors, venues, and event partners from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of:
- Your breach of these Terms
- Your violation of any law, rule, regulation, or venue policy
- Your violation of the rights of a third party
- Your submissions, attendee-shared content, or user-generated content
- Your unauthorized transfer, sale, copying, posting, or misuse of tickets
- Your conduct at or in connection with a Big Dill event
This indemnification obligation applies to the fullest extent permitted by law.
Section 16: Updates to These Terms
Big Dill may update these Terms from time to time. Updates apply prospectively.
The current version of these Terms is always posted at bigdill.com/policies/terms-of-service with a "Last Updated" date and version number.
Material changes affecting purchased tickets will be communicated to ticket holders directly by email where required or appropriate.
For ticket purchases, the version of these Terms in effect at the time of purchase controls the material ticket terms for that purchase, unless a later change is required by law or the purchaser affirmatively agrees to the updated terms.
Section 17: Additional Terms for Promotions, Giveaways, Apps, and Event Features
Big Dill may offer contests, sweepstakes, giveaways, voting programs, scavenger hunts, photo challenges, app-based features, loyalty features, digital passes, interactive games, or other event-related programs. These features may be subject to separate official rules, eligibility requirements, age restrictions, parental consent requirements, privacy terms, sponsor terms, or technology terms.
If separate rules apply, those rules will control for that specific program or feature. If there is a conflict between those rules and these Terms, the more specific rules control for that program or feature, except where prohibited by law.
Section 18: Standard Legal Provisions
Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect, except as specifically stated in Section 13 for arbitration and class-waiver issues.
Entire Agreement
These Terms, together with our Privacy Policy, any specific terms presented at checkout, event-specific terms, product-page terms, official promotion rules, and any terms expressly incorporated by reference, constitute the entire agreement between you and Big Dill for the applicable use, purchase, ticket, product, event, or program.
No Waiver
Big Dill's failure to enforce any provision of these Terms is not a waiver of that provision or our right to enforce it later.
Assignment
You may not assign these Terms without Big Dill's written consent. Big Dill may assign these Terms to any affiliate, successor, purchaser, acquirer, or entity involved in a merger, acquisition, restructuring, or sale of assets.
Termination
These Terms remain in effect unless and until terminated. You may stop using the site at any time. We may terminate these Terms at any time if we believe you have failed to comply with any term or provision, and you remain liable for amounts due through the date of termination.
Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
Conflict With Law
If any provision of these Terms conflicts with applicable law, that provision will be interpreted to the maximum extent permitted by law, and any unenforceable provision will be severed or limited to the extent necessary. Any non-waivable consumer protection, ticketing, accessibility, alcohol, privacy, public-accommodation, or other applicable law controls to the extent required.
